CBCA 101
JIMMY MARTIN,
Appellant,
v.
DEPARTMENT OF AGRICULTURE,
Respondent.
Thomas A. Martin of Martin Law Firm, Jasper, AR, counsel for Appellant.
The case caption as the decision prints it. Every word is kept; the rule the Board draws around it is not text, so it is not repeated here.
Barry D. Hersh, Office of the General Counsel, Department of Agriculture, Little Rock, AR, counsel for Respondent.
POLLACK, Board Judge.
Order
On April 5, 2004, Jimmy Martin filed an appeal from an assessment by the FS of $45,596.32 due to a claimed breach of the contract by appellant. The parties have engaged in lengthy negotiations which have culminated in a settlement. By facsimile dated March 12, 2007, the parties forwarded to the Board their Stipulation of Settlement Agreement and Release. That Stipulation specified that upon execution of the Stipulation, the document would be provided to the Board for entry of judgment.

Accordingly, and based upon the settlement by the parties, the appeal is DISMISSED WITH PREJUDICE.
HOWARD A. POLLACK
Board Judge
This is a verbatim capture of the text layer of the Board's own document in Jimmy Martin, CBCA 101. Nothing is summarized or reworded, and the sections run in the order the Board wrote them. What the page shows and the text does not repeat is the pagination furniture: the page numbers and the rules the Board draws around its caption and under its signatures. The signatures are set back into the columns the Board prints them in, each judge under the name he or she signed, and the typed copy of that name the page carries beneath each signature is not repeated.
