Order
On December 4, 2008, the Government submitted a motion to dismiss the above-captioned claim on the basis of a settlement agreement signed and submitted to the Board by both parties. The parties have agreed to a sum which settles all claims and disputes relating to the lease in question. The matter of attorney fees has also been resolved between the parties.
Accordingly, this appeal is DISMISSED WITH PREJUDICE.
