On July 31, 2009, respondent filed, with appellant’s concurrence, a motion to dismiss this appeal with prejudice pursuant to Board Rule 12(c). The parties advised that they have reached a settlement.
Accordingly, this appeal is DISMISSED WITH PREJUDICE.
