BES DESIGN/BUILD, LLC,
Appellant,
v.
DEPARTMENT OF VETERANS AFFAIRS,
Respondent.
The case caption as the decision prints it. Every word is kept; the rule the Board draws around it is not text, so it is not repeated here.
Todd A. Jones, Peyton D. Mansure, and Lindsey E. Powell of Anderson Jones, PLLC, Raleigh, NC, counsel for Appellant.
Jennifer L. Hedge, Office of General Counsel, Department of Veterans Affairs, Pittsburgh, PA; Laetitia C. Coleman, Office of General Counsel, Department of Veterans Affairs, Arlington, TX; and Timothy M. Saffles, Office of General Counsel, Department of Veterans Affairs, Redwood City, CA, counsel for Respondent.
CHADWICK, Board Judge.
Order
On February 23, 2024, appellant moved “for voluntary dismissal” of this case, citing Board Rule 12(b)(2) (48 CFR 6101.12(b)(2) (2023)). The Board advised appellant on February 29 that it construed the motion as seeking dismissal with prejudice. Appellant did not respond or object.
Accordingly, the appeals are DISMISSED WITH PREJUDICE.
Kyle Chadwick
Board Judge
This is a verbatim capture of the text layer of the Board's own document in BES Design/Build, LLC, CBCA 7306, 7307, 7473, 7474, 7475, 7613, 7614. Nothing is summarized or reworded, and the sections run in the order the Board wrote them. What the page shows and the text does not repeat is the pagination furniture: the page numbers and the rules the Board draws around its caption and under its signatures. The signatures are set back into the columns the Board prints them in, each judge under the name he or she signed, and the typed copy of that name the page carries beneath each signature is not repeated.
