DISMISSED FOR LACK OF JURISDICTION: August 25, 2009
CBCA 1634
JON S. WALDRUP,
Appellant,
v.
DEPARTMENT OF AGRICULTURE,
Respondent.
The case caption as the decision prints it. Every word is kept; the rule the Board draws around it is not text, so it is not repeated here.
Jon S. Waldrup, pro se, Sagle, ID.
Kenneth S. Capps, Office of the General Counsel, Department of Agriculture, Denver, CO, counsel for Respondent.
Before Board Judges SOMERS, POLLACK, and GOODMAN.
GOODMAN, Board Judge.
The Board docketed an appeal from a letter from a contracting officer dated June 26, 2009, that appellant asserted was an appealable contracting officer’s final decision. The Board raised the jurisdictional issue in its initial docketing order and government counsel has advised the Board that after this appeal was docketed, appellant filed a monetary claim on July 10, 2009, and a contracting officer’s final decision will be issued in the near future. This appeal therefore predated the submission of the claim and any final decision to be issued in response to the claim.

This is a verbatim capture of the text layer of the Board's own document in Jon S. Waldrup, CBCA 1634. Nothing is summarized or reworded, and the sections run in the order the Board wrote them. What the page shows and the text does not repeat is the pagination furniture: the page numbers and the rules the Board draws around its caption and under its signatures. The signatures are set back into the columns the Board prints them in, each judge under the name he or she signed, and the typed copy of that name the page carries beneath each signature is not repeated.
