DISMISSED WITH PREJUDICE: November 8, 2023
CBCA 7667
TRADEMASTERS SERVICE, INC.,
Appellant,
v.
GENERAL SERVICES ADMINISTRATION,
Respondent.
The case caption as the decision prints it. Every word is kept; the rule the Board draws around it is not text, so it is not repeated here.
Katherine B. Burrows, Todd M. Reinecker, and Lauren R. Brier of PilieroMazza PLLC, Washington, DC, counsel for Appellant.
Brett A. Pisciotta and David C. Charin, Office of General Counsel, General Services Administration, Washington, DC, counsel for Respondent.
O’ROURKE, Board Judge.
Order
On November 7, 2023, the parties jointly moved the Board to dismiss the above-captioned appeal with prejudice on the basis that appellant amended, recertified, and resubmitted its claim to the contracting officer. The contracting officer denied the second amended claim, and appellant filed an appeal. The new appeal, which the Board docketed as CBCA 7923, renders this one moot. The motion is granted. CBCA 7667 is DISMISSED WITH PREJUDICE.
Kathleen J. O’Rourke
Board Judge
This is a verbatim capture of the text layer of the Board's own document in Trademasters Service, Inc., CBCA 7667. Nothing is summarized or reworded, and the sections run in the order the Board wrote them. What the page shows and the text does not repeat is the pagination furniture: the page numbers and the rules the Board draws around its caption and under its signatures. The signatures are set back into the columns the Board prints them in, each judge under the name he or she signed, and the typed copy of that name the page carries beneath each signature is not repeated.
