J.K. SCANLAN COMPANY, INC.,
Appellant,
v.
DEPARTMENT OF VETERANS AFFAIRS,
Respondent.
The case caption as the decision prints it. Every word is kept; the rule the Board draws around it is not text, so it is not repeated here.
John M. Manfredonia, William E. Thomas, and James Petersen of Manfredonia Law Offices, LLC, Cresskill, NJ, counsel for Appellant.
Katherine M. Smyth, James C. Wagner, and Cameron V. Gore, Office of General Counsel, Department of Veterans Affairs, Washington, DC, counsel for Respondent.
HYATT, Board Judge.
Order
The Department of Veterans Affairs (VA) contracted with J.K. Scanlan Company, Inc. for the supply and installation of a wind turbine at the VA Medical Center in St. Cloud, Minnesota. The contractor filed an appeal challenging the termination for default as wrongful.
The parties successfully engaged in mediation of the dispute, with Board Judge Candida S. Steel acting as mediator.
The parties have now filed a joint motion to dismiss the appeal with prejudice. Accordingly, the appeal is DISMISSED WITH PREJUDICE.

This is a verbatim capture of the text layer of the Board's own document in J.K. Scanlan Company, Inc., CBCA 4469. Nothing is summarized or reworded, and the sections run in the order the Board wrote them. What the page shows and the text does not repeat is the pagination furniture: the page numbers and the rules the Board draws around its caption and under its signatures. The signatures are set back into the columns the Board prints them in, each judge under the name he or she signed, and the typed copy of that name the page carries beneath each signature is not repeated.
