DANIELS, Board Judge (Chairman).

Order

On June 16, 2016, CTA I, LLC (CTA) appealed the deemed denial of a claim it had made under a contract for renovations to the Department of Veterans Affairs (VA) Medical Center in Asheville, North Carolina. CTA characterized its claim as “requesting that the VA acknowledge that it is in breach of contract and that CTA is relieved from further performance under the Contract.”

On June 30, 2016, CTA informed the Board that the VA has terminated this contract for the convenience of the Government. The appellant said that “[t]his renders CTA’s request for declaratory relief on whether it must continue performance moot” and requested that the appeal be dismissed without prejudice.

Accordingly, the appeal is DISMISSED WITHOUT PREJUDICE.

Board Judge

This is a verbatim capture of the text layer of the Board's own document in CTA I, LLC, CBCA 5363. Nothing is summarized or reworded, and the sections run in the order the Board wrote them. What the page shows and the text does not repeat is the pagination furniture: the page numbers and the rules the Board draws around its caption and under its signatures. The signatures are set back into the columns the Board prints them in, each judge under the name he or she signed, and the typed copy of that name the page carries beneath each signature is not repeated.
