v.

DEPARTMENT OF STATE,

Respondent.

The case caption as the decision prints it. Every word is kept; the rule the Board draws around it is not text, so it is not repeated here.

Robert Nichols, Michael Bhargava, and Logan Kemp of Nichols Law, Washington, DC, counsel for Appellant.

Randal Wax, Office of the Legal Adviser, Buildings and Acquisitions, Department of State, Rosslyn, VA, counsel for Respondent.

Before Board Judges KULLBERG, ZISCHKAU, and KANG.

KANG, Board Judge.

Appellant, CGS-ACE Security LLC, appealed a final decision by a contracting officer of respondent, Department of State (DOS), regarding a contract to provide security services. In our recent decision, CGS-ACE Security LLC v. Department of State, CBCA 7965 (July 9, 2026), we granted in part DOS’s cross-motion for summary judgment and denied in part CGS-ACE Security LLC’s cross-motion for summary judgment with regard to payment of certain invoices. We also denied in part DOS’s cross-motion and granted in part CGS-ACE Security LLC’s cross-motion, finding that CGS-ACE Security LLC is entitled to the interest due on the payment of those invoices under the Prompt Payment Act (PPA), 31 U.S.C.

§§ 3101-3907 (2024).

Following the issuance of our decision on the cross-motions for summary judgment, the Board calculated the PPA interest owed to CGS-ACE Security LLC to be €2356. The parties jointly advised that they agree that the amount calculated by the Board is correct for purposes of issuing our decision here.

Decision

CGS-ACE Security LLC’s appeal is GRANTED IN PART. DOS shall pay CGS-ACE Security LLC €2356 for PPA interest, plus interest pursuant to the Contract Disputes Act, 41 U.S.C. § 7109, running from the date that the DOS contracting officer received the certified claim until payment.

This is a verbatim capture of the text layer of the Board's own document in CGS-ACE Security LLC, CBCA 7965. Nothing is summarized or reworded, and the sections run in the order the Board wrote them. What the page shows and the text does not repeat is the pagination furniture: the page numbers and the rules the Board draws around its caption and under its signatures. The signatures are set back into the columns the Board prints them in, each judge under the name he or she signed, and the typed copy of that name the page carries beneath each signature is not repeated.
