DISMISSED WITH PREJUDICE: January 7, 2013
CBCA 2897
ADDICTION RECOVERY SERVICES,
Appellant,
v.
DEPARTMENT OF JUSTICE,
Respondent.
J. Eric Whytsell and Brian W. Stolarz of Jackson Kelly PLLC, Washington, DC,
counsel for Appellant.
William D. Robinson and Oleta L. Thomas, Commercial Law Branch, Federal Bureau
of Prisons, Department of Justice, Washington, DC, counsel for Respondent.
DANIELS, Board Judge (Chairman).
The case caption as the decision prints it. Every word is kept; the rule the Board draws around it is not text, so it is not repeated here.
Order
The Department of Justice’s Bureau of Prisons terminated for cause a contract with Addiction Recovery Services for community-based transitional drug abuse treatment and mental health treatment services in Pittsburgh, Pennsylvania. The contractor appealed the agency’s decision.
The parties now state that they have resolved their dispute and request that the appeal be dismissed with prejudice.
Accordingly, the appeal is DISMISSED WITH PREJUDICE.

Board Judge
This is a verbatim capture of the text layer of the Board's own document in Addiction Recovery Services, CBCA 2897. Nothing is summarized or reworded, and the sections run in the order the Board wrote them. What the page shows and the text does not repeat is the pagination furniture: the page numbers and the rules the Board draws around its caption and under its signatures. The signatures are set back into the columns the Board prints them in, each judge under the name he or she signed, and the typed copy of that name the page carries beneath each signature is not repeated.
